Regulation of rationalization activities

The article analyzes the regulation of legal relations concerning rationalization proposals in Ukraine. German Federative Republic and People’s Republic of China and some other transition economies. The authors have shown that international practice does not provide any common approach to the definition of the notion of rationalization proposal as an object of intellectual property or the state’s participation in the regulation of legal relations in rationalization activities. Basing on the results of the analysis conducted and on the condition of Ukrainian economy, the authors conclude that at the present stage of market reforms in Ukraine it is necessary to elaborate and adopt a general national normative and legal act on regulation of legal relations in rationalization activities. This act should serve as a basis of legal reglamentation of rationalization activities, while on an individual enterprise, where operative rationalization activities are initiated, corresponding issues should be solved by the enterprise itself.

They analyze the correspondence of national laws to the provisions of the Part on “Standards Concerning The Availability, Scope And Use Of Intellectual Property Rights” of the above mentioned Agreement

Regulating the relations of property on the objects of innovation activities

The author provides the results of critical analysis and his position regarding the principal questionable issues related to the regulation of the relations of property on the objects of innovative activities. In particular, he considers the following questions: determination of property rights on the objects of intellectual property whose creation was funded from the budgets of the former USSR and Ukraine; redistribution of property rights on the results of innovative activities due to privatization and corporatization; non-correspondence of the protection of property rights on separate objects of industrial property (by means of declaration patents) to relevant international standards; advisability of the existence of legislative norms regarding “service inventions” etc.

The author analyses basic regularities and tendencies of the market of industrial property at global and national levels. He shows the important role of international institutes in turning the intellectual property into a powerful lever of economic growth. The evolution of the systems of protection of industrial property in Ukraine and Belarus is reviewed in detail in this article. The effectiveness of the national systems of protection of industrial property in Ukraine and in Belarus in the global environment is assessed. The trends in issuance of the patents to foreign countries by Ukraine and Belarus and in obtaining the patents from them are analyzed. The author’s conclusion is that the level of interest in Ukraine and Belarus to protect the objects of indus-trial property in the territories of neighboring countries is quite low.

Technology transfer in the innovation processes in Ukraine and Belarus

IN UKRAINE AND BELARUS
The article presents the main results of a comparative analysis of the institutional provision of the mechanisms of technology transfer in Ukraine and in Belarus as a basis for the revival of innovation processes and technological modernization with the use of the objects of intellectual property right.
The results of the above mentioned analysis conducted on the networks and centers of technology transfer in Ukraine makes it possible to conclude on the absence of a single comprehensive ap-proach to their development. Simultaneous existence of different networks Supervised by different state authorities or institutions leads to the ""erosion” of the available technological potential and inef-ficient use of funds.
Worthy of notice is the Belarus experience where the activities of all scientific and productive bodies is coordinated at the state level. Organization of the system of technology transfer allows the creation of proper conditions for promoting science intensive innovative products both to domestic and foreign markets, and provides necessary methodologies to assess the activities of each type of technology transfer centers.
Comparing the legal bases of Ukraine and Belarus regarding technology transfer reveals the neces-sity of its expansion, in particular, as to transfer and enforcement of property rights of the objects of intellectual property created at the expense of the state budget

The article provides a comprehensive assessment of the efficiency of Ukraine's innovation policy with the use of indicators from the Global Innovation Index. The author points out a high development potential of the sphere of intellectual property, which should become the core of innovation policy and structural modernization of the national economy. Thus, quite high are Ukraine's positions in the group of indicators "Human capital and research" (44th position among 142 countries in 2013), "Knowledge and technology outputs" (45th position), which, in most of their components, are related to the sphere of intellectual property. The problems of innovative development are graphically demonstrated by the low Ukraine's positions in the groups "Institutions" (105th position), "Infrastructure" (91st position), "Market sophistication" (82nd position), and "Business sophistication" (79th position).
It is emphasized that structural reform of the economy and increase in its competitiveness are impossible without a proper development of the national sphere of the protection of industrial property, which is now characterized by low development of the market infrastructure and institutions and low level of the protection of property rights.
The author defines the peculiar features of the organization model for the inclusion of the national systems of the protection of intellectual property in the national priorities of innovative development for different groups of countries depending on their development level. The article shows that the national system of the protection of intellectual property is developing by itself, without being included in the innovative life cycle.
In is pointed out that the period of replacement technological waves creates, for Ukraine, unique possibilities for modernization based on the intellectualization of the economy. Outstripping assimilation and creation of the core of the new technological wave (bio-and laser technologies, nanomaterials, transformation of the health care, telecommunications, agriculture, aircraft manufacturing, ship-building, instrument-making and a series of other branches) may give impetus to the structural reconstruction of the economy and ensure its sustainability provided that a proper reform is conducted in the system of the protection of intellectual property as a component of the innovation policy.

Competitive advantages of Ukraine in the field of the protection of industrial property as a basis for the revival of innovative processes

The article's aim is a comprehensive evaluation of the competitive advantages of Ukraine in the field of the protection of industrial property at global level as a basis for developing appropriate measures to ensure innovation-based economic growth and raising this country's position in the international rating comparisons.
There is an enormous asymmetry in the allocation of objects of industrial property among groups of countries, depending on the level of development and location in certain geographical regions. Ukraine is identified as a country with a lower than average level of gross national income per capita. However, according to the report on “World Intellectual Property Indicators 2015” Ukraine was found in the group of leaders (21st place) among over 140 countries by the generalized indicator of activity in submitting applications for industrial property by country of origin in 2014.
Evaluating Ukraine's competitive advantages by the sub-indexes of the Global Index of Innovation, the author points out the improvement of Ukraine's place in 2014 to 64th place as compared to 71st in 2012. It should be recognized that Ukraine's position in the group of 34 countries with the same level of development is high enough, such as: 4th place by the ranking of the Global Innovation Index, and 3rd place by the resulting subindex (rank 47) and 4th place by efficiency (rank 15). Much worse is this country's position by the subindex of costs: 8th place in the group and the 84th place in the overall ranking.
The evaluations of Ukraine's competitive advantages in the processes of acquiring rights to objects of industrial property as to the intensity of submitting corresponding applications (which are presented in the article) indicate a certain potential that can be enhanced with an active support on the part of the government and leading companies by investing in R&D.

The innovative measurement of Ukraine's euro-integration commitment

In most countries, dynamic development is promoted by effective methods and tools of innovation policy. The implementation of Ukraine's commitment to European integration requires a thorough analysis of strategic initiatives of the EU countries in the innovation field with a view to implementing their main provisions in the programs of government agencies. An integral part of decision-making on improving the methods and tools of innovation policy, both in the individual countries and at the EU level, is monitoring the condition of the innovation systems ac-cording to a specially developed methodology for indicators' calculation and grouping. In the annual report of the European Commission on "European Innovation Scoreboard", for each EU member state and some neighboring countries, indicators are presented that characterize the structural differences of particular economies and the dynamics of the indicators of innovation activities.
The article provides a comprehensive coverage of the main conceptual provisions of the Europe 2020 Strategy and the leading initiative on building the EU Innovation Union as well as the EU Horizon 2020 Framework Program for Research and Innovations. A comparative analysis of Ukraine's rating positions by major groups of indicators of the European Innovation Scoreboard in 2017 has been conducted and it is established that Ukraine's values on the corresponding indicators make up less than a third of the average for the EU-28. The significant differences in the socio-demographic sphere include the more than a ninefold greater than in Ukraine per capita GDP in the EU, a negative growth rate of Ukraine's GDP (-11%), and the lower population density and lower degree of urbanization in Ukraine. This country's scientific sphere has lost financial support both from the state and from private sponsors. Product innovations have failed to become a significant driver in the development of the domestic market and lost their positions in foreign markets. A 4.2% decrease (that is, down to 28.9%) was registered in the ratio of Ukraine's consolidated innovation index for 2010-2016 to the corresponding EU indicator for 2010.
Ukraine needs a radical revision of its policy in the innovation field, taking into account the experience of the transformation of innovation policy in the EU countries.
